Experience as a junior I had a fairly general common law practice but specialised in the law of hire purchase (and some other banking law) and in media law. Experience as leading counsel (silk 1968) I continued to be involved in media law (eg. The thalidomide case for the Sunday Times and the Crossman diaries case), but also practised in commercial cases and did some arbitration work. I had a long arbitration (as arbitrator) in Hong Kong in 1976 and also worked in Nigeria and Bermuda. In 1978 I wrote (with the late Colin Duncan) Duncan & Neill on Defamation (Butterworths). The third edition is in the course of preparation. Experience as High Court judge 1978 – 1984 For the first 2 years I did the usual run of QB work in London and on circuit, though I spent one term largely on VAT appeals. In 1980 I was appointed a judge of the Commercial and Admiralty Courts where I sat periodically for the next 4 years, being the judge in charge of the commercial list in my last year. In 1981 I was also appointed a part-time judge of the Employment Appeal Tribunal. Experience as Lord Justice 1985 – 96 In the Court of Appeal I sat in a very wide range of cases including many cases of judicial review and a considerable number of commercial and employment appeals. For my last 2 years I was the senior Lord Justice. Experience since 1996 Following my retirement in September 1996 I continued to sit from time to time as a member of the Court of Appeal and of the Privy Council. I ceased to do so in 1998. In 1996 I was asked to sit in the Court of Appeal for Gibraltar (the Court sits there twice a year for about 3 weeks) and since 1997 I have been the President. I plan to retire from the Court next March. In addition to my training as a mediator with ADR Chambers I also attended a CEDR course and am an accredited CEDR mediator. I have acted as a mediator on about six occasions in a wide variety of disputes. My main work since 1998 has been as an arbitrator. My recent and current arbitrations include arbitrations (mainly international) in the following areas:
Other experience I was for some years the President of the Society for Computers and Law and was the first chairman of the Information Technology and the Courts Committee (ITAC). |
